1. Overview
These Terms of Service (“Terms”) govern your access to and use of the BrainMail mobile application and related services (collectively, the “Service”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
2. Eligibility
The Service is intended for users located in the United States who are at least 13 years old and capable of entering into a legally binding agreement.
By using the Service, you represent and warrant that you meet these requirements.
3. Your Account & Responsibilities
- You must provide accurate and current account information, including your phone number.
- You are responsible for maintaining the security of your device and account credentials.
- You are responsible for all activity associated with your account.
- You agree to comply with all applicable laws, carrier requirements, and these Terms.
- You may not use the Service for unlawful, abusive, harmful, deceptive, or fraudulent purposes.
4. SMS Messaging
By enabling SMS reminders within the app, you consent to receive text messages related to your saved reminders and account functionality.
Message frequency varies depending on your settings and usage. Message and data rates may apply.
You may opt out at any time by replying STOP. Reply HELP for assistance.
SMS delivery is not guaranteed and may be delayed or unavailable depending on your mobile carrier, network conditions, or device.
5. Subscription Features & Billing
BrainMail may offer optional paid subscription features, including expanded reminder allowances and additional app functionality.
- Payments are processed through Apple’s App Store.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- You may manage or cancel subscriptions through your Apple App Store account settings.
- All billing, refunds, and payment disputes are handled by Apple pursuant to Apple’s policies.
6. Acceptable Use
You agree not to:
- Use the Service to transmit spam, harassment, threats, unlawful material, or abusive content
- Attempt to interfere with, disrupt, or compromise the security or functionality of the Service
- Access, modify, or attempt to obtain data or accounts belonging to other users
- Reverse engineer, copy, exploit, or misuse the Service except as permitted by law
- Use automated systems or bots to abuse the Service
7. User Content
You retain ownership of the entries, reminders, affirmations, reflections, posts, and other content you submit through BrainMail (“User Content”).
By submitting User Content, you grant BrainMail a limited, revocable license to store, process, display, and deliver that content solely for purposes of operating the Service.
You are solely responsible for your User Content and represent that you have the rights necessary to submit it.
8. Community Features
BrainMail may include optional community features that allow users to publicly share content with other users of the Service.
By posting publicly within the Community section, you understand that your content may be visible to other users.
We reserve the right, but not the obligation, to review, moderate, remove, restrict, or disable content or accounts at our sole discretion, including where necessary to:
- Enforce these Terms
- Protect users or the integrity of the platform
- Respond to reports or complaints
- Comply with legal obligations
We do not guarantee the accuracy, reliability, or safety of user-generated community content.
9. Wellness Disclaimer
BrainMail is intended solely as a personal journaling, reflection, and reminder tool.
The Service is not a medical device, healthcare service, mental health service, crisis service, or therapeutic treatment platform.
BrainMail does not provide medical advice, psychological counseling, diagnosis, or treatment of any kind.
If you are experiencing a medical emergency, mental health crisis, or thoughts of self-harm, contact emergency services or a qualified healthcare professional immediately.
10. Third-Party Services
The Service relies on third-party providers to operate core functionality, including:
- Firebase (Google): authentication, cloud database, storage, and backend infrastructure
- Twilio: SMS message delivery
- RevenueCat: subscription and entitlement management
- Apple App Store: billing and payment processing
Your use of the Service may also be subject to the terms and privacy policies of these providers.
11. Intellectual Property
Except for User Content, all rights, title, and interest in the Service, including software, branding, graphics, design, and functionality, are owned by BrainMail or its licensors and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, reverse engineer, or commercially exploit the Service except as expressly permitted by law.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not guarantee uninterrupted availability, error-free operation, or successful delivery of SMS messages or notifications.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRAINMAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
14. Account Deletion
You may delete your account directly within the app or by contacting: brainmailhelp@gmail.com
Upon account deletion:
- Your account authentication information will be deleted
- Your saved entries and reminders will be removed
- Your community posts may be removed
- Scheduled SMS reminders will be canceled
15. Termination
We reserve the right to suspend, restrict, or terminate access to the Service at any time where reasonably necessary to:
- Enforce these Terms
- Prevent abuse or security risks
- Protect users or the Service
- Comply with legal obligations
16. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in courts located within the United States.
17. Changes to These Terms
We may update these Terms from time to time.
Updated versions will be posted with a revised “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
